Canada is pursuing the highest levels of immigration in its history to support its post-COVID economic recovery. As such, Canada aims to welcome over 400,000 new immigrants per year, of which, over 100,000 immigrants per year fall under the family class.\r\n

    \r\n The country's immigration system is managed by the Department of Immigration, Refugees and Citizenship Canada or IRCC for short. The department was previously known as Citizenship and Immigration Canada, or CIC for short. IRCC establishes and administers Canada's family sponsorship program. This entails establishing program criteria, accepting and reviewing family sponsorship applications, and providing permanent and temporary resident visas.\r\n\r\n

    \r\n What is Canadian family sponsorship?\r\n

    There are two main aspects to sponsorship:

    • It allows your family member to immigrate to Canada and get permanent residence (PR).\r\n

    \r\n While the processing of sponsorship applications has been affected by the coronavirus pandemic, the Canadian government continues to look for innovative and compassionate ways to reunite families.\r\n

    \r\n Here are some of the steps that have been taken:\r\n

    • IRCC has increased the number of staff who will review spousal sponsorship applications by 66% to reduce wait times and process applications more quickly.

For that reason, everyone’s path to Canadian immigration will be unique.\r\nFor example, there are many different ways for professionals and workers to qualify for a Canada Immigration permanent resident visa. The most prominent option is through Express Entry, which is Canada's main pathway for economic class skilled workers. Your best bet to be eligible under Express Entry is to meet the requirements of either the Federal Skilled Worker Program (FSWP) or Canadian Experience Class (CEC). Canada's second largest pathway for skilled workers is the Provincial Nominee Program (PNP). Nearly every province and territory operates the PNP so they can select immigrants that meet the needs of their local job markets. The third major option is immigrating to the province of Quebec, which operates notable pathways such as the Quebec Skilled Worker Program and the Quebec Experience Class. \r\nIf you want to obtain Canadian permanent residence as a business immigrant, you have a number of options such as the Federal Self-Employed Program, the Start-up Visa, and entrepreneur programs operated under the PNP and by Quebec.\r\nCanada offers a number of family class sponsorship programs.     \r\n The global coronavirus pandemic is impacting Canada's immigration system. Nonetheless, since the start of the pandemic, the Canadian government has maintained a strong commitment to processing immigration applications to the best of its ability. The department of Immigration, Refugees and Citizenship Canada (IRCC) continues to welcome new immigration applications and is processing as many of them as it can so that immigrants can come to Canada during and after the pandemic. Express Entry draws continue to occur approximately every two weeks with candidates all over the world receiving permanent residence invitations.\r\nMoreover, the pandemic has led to Canada strengthening its commitment to immigration. Near the end of 2020, Canada announced it will increase its annual immigration target to over 400,000 new immigrants per year, which is the highest level in its history. Prior to the COVID-19 pandemic, Canada's target was over 340,000 new immigrants per year. At the beginning of 2021, Canada's Immigration Minister Marco Mendicino expressed confidence that these high immigration targets are realistic during the pandemic.\r\n

    \r\n Why Does Canada Need Immigrants?\r\n

    \r\n Canada welcomes immigrants under three classes: the economic class, family class, and refugee and humanitarian class.

    \r\n Skilled workers are welcomed under the economic class to support Canada’s high living standards. Canada has an aging population and low birth rate which is why most of the immigrants, it welcomes are skilled workers. Canada needs these skilled workers to support its labour force and economic growth. These skilled workers arrive with strong language skills, work experience, and education, and desire to succeed. Hence, they play a vital role in Canada’s efforts to support economic growth and social services such as education and universal health care.\r\n

    \r\n The second largest immigrant class arrives through family sponsorship. Canada welcomes the loved ones of Canadian citizens and permanent residents since strong families are the bedrock of Canada’s society and economy. Allowing close family members to build a life in Canada provides families with the emotional support they need to thrive in the country’s society and economy.\r\n

    \r\n The third largest class are welcomed as refugees and for humanitarian purposes. As one of the world’s most privileged nations, Canada has a moral obligation to provide safety to those fleeing persecution and other \r\n \r\n hardship. Canada has a long tradition since the end of the Second World War of demonstrating humanitarian leadership. In 1986, the United Nations awarded the people of Canada the Nansen Medal, which is the UN's highest honour for those who demonstrate excellence in helping refugees. Canada remains the first and only country to receive the Nansen Medal.\r\n

    \r\n Skilled Worker Immigration Pathways\r\n

    \r\n Under its Immigration Levels Plan, Canada aims to welcome over 400,000 immigrants every year. Some 60 per cent of these immigrants arrive as skilled workers. The main way skilled workers can immigrate to Canada is through the Express Entry application management system. The second main way is through the Provincial Nominee Program (PNP), followed by Quebec’s skilled worker programs, and then a few other targeted federal programs.\r\n\r\n

    Provincial Nominee Program (PNP)

    \r\n \t Through the Provincial Nominee Programs (PNP) Provincial Nominee Programs (PNP), Canada’s provinces and territories can nominate people who wish to immigrate to Canada and reside in a particular province. Canada seeks to welcome over 80,000 immigrants per year under the PNP.\r\n

    \r\n All provinces and territories, except for Quebec and Nunavut, has its own PNP. Each province determines its own criteria for choosing eligible candidates. PNPs operate Expression of Interest (EOI) systems, similar to Express Entry, and invite the candidates in regular draws.\r\n

    \r\n You do not need to have an Express Entry profile to apply. You can apply directly to a PNP stream. These are called ‘base’ streams .\r\n

    \r\n You can also apply to PNP streams that are aligned with Express Entry. These are called ‘enhanced’ streams. The benefit of applying to an enhanced stream is that it gives you more options.\r\n



    \r\n Receiving a provincial nomination through these streams awards Express Entry candidates an additional 600 Comprehensive Ranking System (CRS) points. This practically guarantees receiving an invitation to apply for permanent residence in a subsequent Express Entry draw. \r\n

    \r\n Atlantic Immigration Pilot\r\n

    \r\n Atlantic Canada has its own immigration program called the Atlantic Immigration Pilot (AIP). The AIP is a fast-track immigration program that allows employers to attract and retain foreign talent. Atlantic Canada includes four provinces:\r\n \r\n

Once the candidate accepts the offer, the employer must connect the candidate with a designated organization that will help him or her develop a settlement plan. Employers who wish to quickly fill the position may also have access to a temporary work permit.\r\n

    What is Inadmissibility?

    Canada is one of the most open countries on the planet welcoming millions of tourists, visitors, immigrants, foreign workers, and students each year. At the same time, Canada ensures each foreign national passes its admissibility requirements before they are allowed to enter the country. One of the areas that Canada screens for is your criminal background.

    What is Criminal Inadmissibility in Canada?
    \r\n

    Criminal inadmissibility is when an individual is denied entry to Canada on grounds of criminality reasons. If you have committed an act outside Canada that is an offence in both the country in which it took place and in Canada, you could be denied entry.\r\n

    \r\n Here are some of the factors that may make you criminally inadmissible without ever having set foot in Canada:\r\n

      \r\n
    • If you were convicted in a foreign country of an act that Canadian law also recognizes as a criminal offence. You could be considered criminally inadmissible if Canada would consider your crime an “indictable offence,” which generally refers to a more serious crime. In the U.S. it is comparable to a felony.
    • \r\n
    • If you have two non-indictable offences from separate acts, you may also be inadmissible. As the name suggests, these are less serious than indictable offences, and are generally comparable to misdemeanors in the U.S.
    • \r\n
    \r\n
    \r\n It is important to note that a conviction is not necessary for events that occurred outside of Canada to result in inadmissibility. In certain instances, an arrest or charge may result in questioning from Canadian border authorities.\r\n

    \r\n Although the foreign equivalent of a Canadian Criminal Code infraction is the most common cause of inadmissibility, an offence that equates to a violation of any Canadian federal law can also result in inadmissibility. If you have been determined to have committed an act in a foreign country that is both an offence in that country, and an indictable offence in Canada, you may also be criminally inadmissible. The same applies to two or more crimes that are summary offences in Canada. All that is required is credible evidence that you committed the act. This category is meant to catch individuals with unresolved criminal charges.\r\n

    \r\n Temporary residents and applicants for permanent residency can be deemed criminally inadmissible if they:\r\n

    \r\n
      \r\n
    • Were convicted of an offence in Canada;
    • \r\n
    • Were convicted of an offence outside of Canada that is a crime according to the laws of both that country and Canada; or
    • \r\n
    • Committed a crime according to the laws of another country that would also be punishable in Canada.

    \r\n Keep in mind: Foreign convictions, acts, and laws are compared to Canadian laws and standards when determining an individual’s criminal inadmissibility.\r\n \r\n

    There are two types of work permit programs in Canada:\r\n

    \r\n The purpose of the LMIA is for employers to demonstrate to the Canadian government that the hiring of a foreign worker will not have a negative impact on Canada's existing workforce. The federal department of Employment and Social Development Canada (ESDC) wants to ensure that the hiring of foreign workers will not displace existing workers in Canada nor place downward pressures on their wages. Workers that need an LMIA fall under the Temporary Foreign Worker Program (TFWP).\r\n

    \r\n Although the LMIA process is the rule, there are many different LMIA-exempt work permits, resulting from free trade agreements, such as the former North American Free Trade Agreement, now known as the Canada-United States-Mexico Agreement, or CUSMA . These free trade agreements enable foreign workers to apply for a work permit without their employer having to obtain an LMIA. In addition to these employer sponsored work permits, there are a number of work permit options available to foreign workers who do not yet have a job offer, including working holidays, post-graduate work permits, and open spousal work permits. Workers who do not need an LMIA fall under the International Mobility Program (IMP) .\r\n
